We regularly act for clients in mediation and informal settlement conferences to resolve disputes in a timely and cost efficient manner.
Mediation is a non-determinative process of facilitated discussion and negotiation. Parties in dispute engage a mediator, an independent third party, to facilitate communication and assist the parties in reaching a mutually agreeable solution.
Mediation offers many benefits including being voluntary, confidential, efficient and flexible. Rather than being bound by the decision of a judge or arbitrator, resolution of the dispute is reached by agreement of the parties.
Mediation also provides parties with the opportunity of focussing on their subjective needs and interests as opposed to being restricted to arguing about their objective “legal” rights, as is the case in litigation or arbitration.
